Good afternoon bikers, bourbon connoisseurs, cigar aficionados, Second Amendment supporters and everyone who loves FREEDOM! šŗšø Recently, I wrote an article about a victory Gun Owners of America helped bring about through the Federal lawsuit: Silencer Shop Foundation v. ATF.Ā This lawsuit was filed almost immediately after President Donald Trump signed the Big Beautiful Bill – one component of which was getting rid of the Federal tax stamp fee on certain National Firearms Act (NFA)Ā items – specifically short-barreled rifles, short-barreled shotguns and suppressors. Click HERE for my complete post.
This excerpt from my article describes the lawsuit and its impetus being the signing of the Big Beautiful Bill:

Here is an excerpt which describes the ruling of the Federal District Court in North Texas:

At the time of this ruling, plaintiffs in the case no longer needed to fill out ATF Form 4 (in most states other than bright BLUE states) and wait months for ATF approval to take possession of the items described above. All the purchasers had to do was fill out a standard firearm background check Form 4473 and get near instant approval from the FBI – at which point they could walk out of their local gun shop with their suppressor, short-barrel rifle or short barrel shotgun. Boom! š„ What an awesome deal! š„
Now for the bad part – could this all be undone by a new administration or Congress?
It was made clear by U.S. District Court Judge Hendrix that because the NFA was never designed as a restriction on firearms ownership, but rather a Federal government tax on certain items, the Form 4 requirement was unconstitutional. But what happens if the tax is reinstated? Watch this Newsmax clip from Carl Higbee’s Front Line interview with current ATF director, Robert Cekada, which originally aired on October 13, 2026:
Frankly, this is frightening to think about. If our federal legislature reinstates the NFA tax, and as the ATF director noted: it could be as little as $1.00, it will likely nullify Judge Hendrix’s ruling and require the ATF Form 4 be filled out and the long wait to possess the NFA items would go back into force.
Here are the most obvious potential outcomes of this:
- Surrender the NFA items you purchased legally after the court ruling due to them being illegal contraband
- Purchasers would receive “amnesty” from the Federal government and be able to keep their items (I’d never count on this with a gun grabbing Democrat administration and legislature)
- Fill out ATF Form 4 and wait for approval from ATF to keep the items you purchased and have possession of? (are you illegally owning contraband while you wait for their approval?)
- Purchasers of these NFA items would be grandfathered and not need to do anything (highly unlikely since they want your tax payment)
If this doesn’t terrify you, I do not know what would. We know that trusting the government is a very dangerous proposition. Since the vast majority of people who purchase items such as these are moderate to conservative, the chance of us being persecuted by the Feds seems to be more than plausible. Clearly, as of today, there is not much which will come from this potential shortfall of Judge Hendrix’s ruling. Even if the Democrats win majorities in both the House and Senate, President Trump could, and likely would, veto any bill which attempts to reinstate the tax on NFA items. But, the potential of having the Democrats controlling the Executive and Legislative branches could become a reality as early as January 2029. This is why we must always have our voice heard through the ballot box!
